AB 2524 Law And What It Means For You

AB 2524 was the new law which changed 114328 of the retail food code regarding Catering Operations. Essentially, a Catering operation refers to a permanent food facility approved for offsite food service activities.Effective 1/1/2019, catering operation is included within the definition of a food facility and must comply with the requirements of the California Retail Food Code (CRFC).

With the passage of Assembly Bill No. 2524, a “catering operation” and “host facility” would be included within the definition of a food facility. A host facility is a location approved and permitted by the County that meets requirements to support offsite food service by a catering operation. This bill went into effect on January 1, 2019. The law essentially produces new regulations for catering operations.

The prevailing wisdom is that many of the current commissaries are inadequate to meet the new rigor of the law. Pro-Culinary followed all the new guidelines to be a licensed host facility. Mike Cook from Pro-Culinary sums things up like this:

“No longer can anyone just hire whom they seem fit to cater their event. The law makes no distinction between hiring "Joe's Catering" to provide you with chicken for 25 people and you ordering from KFC. KFC, as all other restaurants, are licensed, and face greater scrutiny and regulation. the law has now passed that on to the catering operations. Our observation has been that Fresno's first step in enforcing this new law, is regulating the host facilities.

Fresno County Environmental Health Department wants to ensure that all Catering Operations work out of a permitted food facility that is capable of supporting the proposed food service activity to be conducted, and the type of food that is to be prepared offsite or served.
